继承土地承包经营权法定流转新形式初探

A Primary Exploration of the New Way of the Circulation of Rural Land Contracted Management Right:Succession

在现行的法律中继承没有明确被规定为农村土地承包经营权流转的方式之一。但是,继承可以作为农村土地承包经营权法定的流转方式有特定的法理以及法律依据:新的《物权法》规定土地承包经营权为用益物权;《继承法》第三、四条和《农业法》第十三条也为继承可以作为土地承包经营权法定流转方式的存在提供了法律渊源。在实务中继承作为流转方式遭遇到的疑难,也具有可行的策略予以解决。

The present law does not make clear provision that succession is one of the legal ways of the circulation of rural land contracted management right. However, that succession can serve as a legal way of the circulation of rural land contracted management right has particular legal basis： the new Property Law states that the right to the contracted management of land belongs to usufructuary right; the third and fourth articles of Law of Succession and the thirteenth article of Agriculture Law provide legal sources for this; and the doubts and difficulties encountered in the practice of succession as a legal way of circulation can be solved by proper tactics.
