农地发展权在土地权利体系中的地位及其相互关系研究

A Research on Status and Relationship of Rural Land Development Right in Land Right System of China

农地发展权在过去很长一段时间里淹没在土地所有权中,随着社会经济发展对土地需求压力的增加,国家对土地利用的控制也进一步增强,这一权利的社会实现和价值体现才逐步增强。通过介绍农地发展权的概念与内涵,对其在土地权利体系中的地位与作用进行了分析,分别探讨了其与土地权利体系中几个主要土地权利的关系。

The rural land development right, one of the state land rights, was merged in the land ownership in the past years. With the increasing pressure on land demand from social and economic development, the state has enhanced the control of land use, strengthening the value of the rural land development right. This paper explains the notion and meaning of the rural land development right, analyzes the status and function of the right in land right system of China. Finally, the paper discusses the relationship between the rural land development right and several main land rights.
