A Jurisprudential Analysis of the Conflict between Farmers’ Land Rights and Resource Development

农民地权与资源开发的冲突已成为社会经济发展中的一个突出问题。本文从民事权利的角度,分析了农民地权与资源开发之间冲突的法理问题特别是财产权利结构的内在紧张,指出更新地权理论的必要性。在此基础上,提出解决农民地权和资源开发冲突应着眼于收益分配机制的完善和财产权利观的调整。

The conflict between farmers’ land rights and resource development has become one of the leading issues in social economic development. From a civil rights perspective, this article analyzes the jurisprudential issues in the conflict between farmers’ land rights and resource development, especially the internal tension over the structure of property rights, and highlights the need to update land rights theory. Based on this analysis, it is necessary to focus on optimizing a profit sharing system and adjust property rights concepts to resolve the underlying conflict.
