英国国际私法之基本范畴探究

Tradition and Reform:On the Basic Concepts of English Private International Law

英国国际私法基本范畴的变革,是当代英国国际私法变革的根本所在。当代英国国际私法的基本范畴有机融合了大陆法系和其他英美法系国家的诸多元素,具有显著的英国特色。英国国际私法名称的变化、更加多元化的法律渊源、日益发达的成文法解释以及所反映出的实用主义传统,都是英国国际私法基本范畴凸显的特色。但是,随着欧共体法最高地位在英国的确立,英国国际私法体系发生了重大变革,其性质、定义等基本概念也应随之发生变化。

The reform on the basic concepts of English Private International Law （EPIL） is the foundation of the reform on current EPIL. The system of the basic concepts of current EPIL has remarkable English characteristics, which is an organic fusion of many elements from the Continental Law System and the Anglo-American Law System. As concerning EPIL, the change of its name, more legal resources, increasingly advanced statutory interpretations as well as the tradition of pragmatism, are all the characteristics of the system of the basic concepts of EPIL. With the establishment of the supremacy of community law, however, the system of EPIL has been changed greatly, and its basic concepts such as its nature and definition shall have a corresponding reform.
