State Law and Non-governmental Law in Legal Economics

在越来越具有现代性特征的乡村社会,国家法律已日益成为维护社会秩序、促进社会和谐、保障新农村建设不可或缺的力量。但作为村庄内部维系秩序的权威力量,即"民间法",在社会生活中仍起着作用。应正确认识国家法与民间法的关系,建立二者之间均衡互动的调节系统,发挥二者各自的作用,以促进和谐社会的构建。

In a rural society which is increasingly characterized with modernity, state law has turned to be a necessa- ry force in keeping the social order, promoting the social harmony and guaranteeing the building of a new country. Yet in the meantime, there exists a sort of force or authority that helps keep the order inside the rural society, that is the non-govern- mental law. It is imperative for us to correctly understand their relations and set up an interactive and coordinating system so as to give full play to them and promote the building of a harmonious society.
