摘要
我国《物权法》第181条首次确立了浮动抵押制度。浮动抵押突破了传统物权法上的物权客体特定原则和一般抵押权规范,具有重大的立法价值。但是,在抵押权的效力、抵押权的实现以及抵押权人的权利保障等方面,《物权法》的规定尚存一些不足和缺陷,亟须解释和完善。
Floating charge system was established for the first time in Article 181 of China s "Property Law".The system broke through the principle of specific property object and general mortgage rules in the traditional property law,being of great legislative value.However,there are still some shortcomings and deficiencies in the effectiveness,realization and protection of the mortgagee in the "Property Law",and it is urgent to be interpreted and improved for the system.
