征地补偿现存问题的分析——以河南省新乡市、安阳县为例

On the Existing Problems in Compensation for Expropriated Land——Take Xinxiang,Anyang in Henan as Example

文章以河南省新乡市、安阳县为例,分析征地补偿中的征地补偿金额偏低、地方政府借"村改居"名义侵犯失地农民获得补偿的权利、各地征地补偿分配纠纷多、法院受理该类纠纷难和我国缺乏土地承包经营权征收补偿制度等问题。

By takeing Anyang and Xinxiang in Henan as example, this paper analyses the problems in compensation for expropriated land, such as low compensation standard on expropriated land, local government impinged on losing land farmer＇s rights of obtained compensation in the name of ＂rural to urban resident status transfer＂, dispute of the distribution of the compensation which is hard to be accepted by the People＇s Court and the imperfect of the compensation system for expropriated right of operation of land.
