摘要
商誉权不具有人格权属性,对其属性争议的根源在于误认为其具有"人格、财产双重属性"。商誉权的客体是商誉,商誉体现为社会公众对某一特定企业的综合评价,本质是反映企业等主体的"结构性信息",是企业一系列智力活动的成果,属于创新性智力成果。知识产权的客体是创新性智力成果,本质上是信息,因而商誉权是具有自身特色的知识产权。
Goodwill right does not possess the personality attribute.The reason for disputes of its attributes lies in the misconception that there are double natures of goodwill right referred to as personality and property.The object of goodwill right is goodwill,which is embodied as comprehensive evaluation that the public made for a certain enterprise,and the essence of it is structured information reflecting subjects like enterprises.In other words,goodwill is a result of a series of enterprises' intellectual activities and thus belongs to the category of innovative intellectual achievement.The object of intellectual property right is intellectual achievements and it is a kind of information in essence.Therefore,goodwill right is a kind of intellectual property right with features of itself.
