Comparative Study for National Compensation Systems

中国和德国共同属于大陆法系国家,德国的国家赔偿制度己发展了一百多年,已经相当完善。试从概念体系、功能、归责原则、赔偿范围、赔偿义务机关、赔偿费用的执行等几方面解读德国的国家赔偿制度,并与中国的现行国家赔偿制度相比较,以期对中国的国家赔偿法的修改有所借鉴。

China and Germany belong to the mainland legal system countries together, Germany＇s national compensation system oneself has developed for more than 100 years, and already quite consummated. This article tries from the concept systems, the functions, the principles to turn over to the responsibility, the compensation scope, the compensation duty institutions, the execution of compensation expense, and several aspects to explain Germany＇s national compensation system, and compares with China＇s present national compensation system, hoping to be used for reference for the revision of China＇s national restitution law.
