权威合法化与现代国家的正当统治

Authority Legitimization and the legitimate rule of modern state

权力的实现要以形成权威为归宿和保证,即权力必须转化为权威方能获得长期统治,一个缺乏足够的合法性资源支撑的权力终究会丧失让人服从的权威性。任何社会形态都需要通过某种形式将权威合法化,合法的权威是保证国家忠诚、维护国家稳定的重要元素。文章分析了权力、合法性和权威的内在关联,结合西方宪政主义权威理论,立足中国特殊的国情,探讨国家建立其正当统治的路径,以期有助于推进当代中国法治与政治文明的建设。

The realization of the power should take the formation of authority as the end-result and guarantee, that is to say the power must be converted to the authority to get the long-term rule. The power which lacks the support of adequate legitimacy resource will eventually lose the authority of their people＇s submission. Any social formation requires the authority legalization through some form, and legal authority is an important dement to ensure that national loyalty and stability. Combined with the authority theory of the Western constitutionalism, based on China＇s special national conditions, this paper analyzes the intrinsic correlation between the power, legitimacy and authority, put forward the route for the country to established their legitimate rule, with a view to help promote the construction of rule of law and political civilization of Contemporary China.
