关于相邻不可量物侵害的比较法研究

Comparative Study on Law of Neighboring Violation on Immeasurable Matter

随着时代的发展,侵害形式呈现多样化特点,不可量物侵害便是其中之一。文章从比较法的角度,着重分析了德国和英美就不可量物侵害问题的规定以及相关的理论成果,同时就《物权法》颁布前后我国的立法情况作了简要梳理,以期通过对比、借鉴发现我国目前在这一问题领域的不足。

As time proceeds,neighboring violation has resulted from the diversification of violation on immeasurable matter.This paper makes a brief introduction to the situations before and after the issuance of Property Law in China,and compares these to those in western countries like Germany,Britain and America.Weaknesses of Chinese domestic laws regarding violation immeasurable matter are thus exposed.The paper proposes measures to remedy the current laws and regulations in China.
