论国际扶养制度与我国实践

On Legal System of International Maintenance and Practice in China

扶养是婚姻家庭法律制度中一个重要的组成部分,随着我国开放程度的深入以及与各国交往的日益频繁,涉外扶养案件也不断增加.然而由于各国对扶养法律制度的规定的差异,导致了扶养法律冲突问题的出现.本文主要首先从扶养的概念入手,然后介绍国际扶养法律冲突的特点和解决的途径,最后分析我国扶养法律制度的现状和缺陷,提出相关的完善建议。

Maintenance is an important component of the legal system of marriage and family. Along with the deepening of China＇ s opening-up and increasing frequency of exchanges with other counties, cases of foreign maintenance are also on the rise. However, due to the differences in legal maintenance system of different countries, legal conflicts on intemational maintenance emerge. This article firstly introduces the concept of maintenance. Then it elaborates on the features of legal conflicts on international maintenance and their solutions. Lastly, it analyses the current situation and defects of China＇ s legal system of maintenance status and gives some relative proposals for improvement.
