庭审诉讼指挥权:问题及排解

法院行使诉讼指挥权有其理论依据,它利于提高诉讼效率,促进实质公正,也符合我国的司法传统。当前法官在行使庭审指挥权时存在四个方面的问题,应从五个方面进行规范和完善,即加强庭前准备工作,明确庭审指挥权的内容,建立庭审指挥权纠错机制,建立家事案件庭前调解制度,强化对法官的庭审能力考评工作。

The command of the court proceedings has the theoretical basis, it helps improve the efficiency of judicial action, promotes real justice, and conforms to China＇ s judicial tradition. At present, the trial judge in the exercise of the right exists four problems, and should standardize and perfect it in five issues, that is, strengthening pre-trial preparations, clearing the contents of command of court trial, establishing command of the court trial error correction mechanism, establishing pretrial mediation system of family cases, strengthening the evaluation capacity of the trial judges.
