在英国刑法中,根据不同的构成要件非致命人身伤害罪包含有普通威胁罪、殴打罪、伤害罪、严重侵害人身罪等具体罪名。在这里笔者主要就普通威胁罪和殴打罪各自的构成要件、相互区别及我国对此类行为的认定处罚进行论述,并从刑事立法的角度,简要论证二者对我国刑事立法的实践价值。
