对体育课教学伤害事故处理中行政处分的研究

Administrative sanction against injury accidents happened during PE-teaching

运用文献资料、专家访谈对体育课教学中引发的伤害事故进行研究后认为:对体育课教学中引发伤害事故的责任人进行行政处分有其必要性,也有法律依据。根据体育课教学中伤害事故发生的不同情形,提出给予不同责任人行政处分的种类和适用,及其行政处分行为的实施、监督和救济。建议有规章制定权的省(市)人民政府、教育部从速制定有关规章,使体育课教学中伤害事故的行政处分有章可循。

After studying the injury accidents happened during PE class and through looking into literature materials and talking with experts,we think there is a great necessity and stable law-basis for administrative sanction against those people who are responsible for those injury accidents.Based on different injury accidents happened during PE teaching,we suggest different kinds and adaptions of administrative sanction against people who should be responsible,also with the carrying-out,surveillance and aims-giving on these administrative sanction actions. We suggest that the provincial government and Ministy of Education who hold the rule - making power should make rules settled down as soon as possible, to make administrative sanction happened during PE teaching lawful.
