摘要
儒家建构了一个德、刑、礼三位一体的治道模式。德治强调逻辑是一个上行下效的价值导向过程,奠基于生态感应论的理论预设之上;法治强调构建强制性的他律体系,逻辑上落实于"惩于已然之后"的追溯机制,其生态合理性是一种生存论上的"共生法则";礼治之运作图式乃内修其本、外齐以礼的双向互动过程,其"原生态"土壤是"礼本于自然"。
Construction of a Confucian virtue,rite and punishment,at the threein-one model of Governance,had been finished.The rule of virtue stressed the virtue s effect for the people.Its inherent logic is to permeate among the value-oriented process,a process founded on the ecological induction.The rule of law so as to the sentence based on law,stressed on the construction of a mandatory legal system,implementing logic in the retrospective mechanism,and the ecological rationality is a survival of the "symbiotic law" Ceremony is to rule within and outside virtue, which operation plans for the perfonnance- accomplishment within its own and outside- in ceremony of the two- way interactive process, and it take root to the true ecological soil for ceremony governance which the rite based on the naturalness.
