知识产权纠纷诉讼调解机制研究

Research on Lawsuit Mediation of Intellectual Property Dispute

随着社会、经济活动的扩大,人们相互交往机会的增多,知识产权纠纷也不断增多。诉讼调解作为解决这类纠纷的有效机制日益受到法院的重视。本文以知识产权纠纷为主要研究对象,在分析了法院诉讼调解实际情况的基础上,阐述了诉讼调解对于解决该类纠纷的重要价值,并从法官、当事人和律师的角度分别探讨了调解策略的构建,最后提出了充分发挥诉讼调解功能的建议。

Along with the development of society, intellectual property disputes continuously increase. Lawsuit mediation as an effective mechanism for resolving the disputes is becoming more of a concern by the court. This paper takes the intellectual property dispute as the main research object, and especially elucidates significant value for resolving the dispute on the basis of analyzing the actual situation of lawsuit mediation in the court. In view of this, China＇s lawsuit mediation reform should construct mediation strategy from the perspective of judge, party and lawyers, and give full play to the functions of lawsuit mediation of intellectual property dispute.
