论清代蒙古族婚姻法的变迁

On changes of Mongolia marriage law in Qing dynasty

蒙古历代法律都对婚姻制度作出规定,研究清代蒙古婚姻法及其变迁,就可以理解该亲属法在法制变迁中的特点。清代有关婚姻制度的立法仅涉及婚约、聘礼、婚姻的终止和治奸等方面,与其他的部门法相比显得较少,这正说明亲属法是一个民族法律文化中最为保守的部分,法制变革中对亲属法的尊重和继承恰是最应该的选择。

Every law of Mongolia at any age always had rules for the institution of marriage. By studying on marriage law and its change in the Qing dynasty, we can understand the characteris- tics of the change of the relative laws. In the Qing dynasty the legislation related only to engagement, betrothal gifts, divorce and penalty to rape and so on, it is relatively less than other de- partment of laws, which indicates that the relative law is the most conservative in the national legal culture, the respect and inheritance for the relative law should be the most appropriate choice in the legal reformation.
