摘要
劳动者乙与某大型国有企业甲签订了劳务协议,协议条款简单,不符合《劳动合同法》之必备条款的规定,违反公平原则,内容不明确,为此,双方发生劳动纠纷。虽经双方协商,纠纷得以解决,但却引起了我们的深刻思考,正确使用合同名称,规范合同条款,最好使用第三方制定的格式合同,都是劳动合同签订过程中应该注意的问题。
Employee B and A, a national company sign a labor contract, the content of the contract is simple and not consistent with the obligatory article of the contract prescribed in the labor contract law, the content is contrary to fair principle and undefined. Thus the labor dispute happened to them. The dispute is solved by consulting, but it arouse our deep thinking. Using the name of the contract correctly, regulating the article of the contract, using the standard contract writing by third party are problems that we should think of.
