内外兼修遏制刑讯逼供

On Curbing Inquisition by Torture from Both Inside and Outside

遏制刑讯逼供,如果仅仅从外部进行侦查讯问权力的制约,只能够过滤掉非法的刑讯手段和方式,却不能打破既存的侦查讯问僵局,加快推进合法的讯问进程,提高侦查讯问破案的效率。因此,在考虑通过程序性规制降低刑讯逼供可能发生的同时,在讯问体制内部寻求讯问策略、手段和方法的创新,以及从整个刑事诉讼宏观体系出发,部分调整诉讼程序的结构和证据规则,给侦查讯问提供良好的运行空间,同样是遏制刑讯逼供所要重点考虑的问题。

With a view to curbing inquisition by torture, if we just constrain the power of criminal investigation and inquisition from the outside, we may only filter out illegal methods of interrogation, but we can＇t break the existing deadlock in criminal interrogation, nor accelerate the legitimate interrogation process, nor improve ＇the efficiency of case detection. Therefore, while we consider adopting procedural regulations to reduce the occurrence of inquisition by torture, we＇re suggested to search for innovations in inquisition strategies, means and methods and partly adjust the structure of litigation procedure and evidence rules from the macroscopic respect of criminal lawsuit system to provide a good operating space for criminal interrogation, which deserves our reconsiderations on curbing inquisition by torture.
