摘要
"人"的自身意识往往是在对外界事物的探究过程中,通过反思而产生的。在这一过程中,认识的对象反而成为了"人"观察自身的媒介,形成一种"镜式结构"。而"人"的镜象不断地在这些媒介中得到呈现。尽管不同的"媒介"仅仅能勾画出有限的"人"的镜象,但正是在这些不断的彰显中,"人"的意义得到了充实。法律作为人类社会最为重要的文明现象,无疑是一种反射"人"之意义的重要镜象。通过对"人"与"法"的镜式结构的梳理,我们能够在更深层次的意义上来认识"人"是什么。同时,也更好地认识法律本身。
A person comes into self-awareness through self-reflection in the process of exploring the outside world. In this process, the object to be undersdood turns out to be the medium or mirror through which a person comes to know himself. A person is constantly reflected through thoses mirrors. Limited as those images are, they present an outline of a person, enriching the meaning of the subject. The law of human society as the most important phenome- na of civilization, is no doubt an important mirror of the meaning of a person. An analysis of the relationship be- tween a person and the law as a mirror can further the understanding of a person and the law itself.
