藏族婚姻习俗与现代婚姻法的冲突与调适——以西藏地区为例

The Conflict and the Adjustment Between Tibetan Marriage Customs and the Modern Marriage Law——Taking the Tibetan as Examples

聚居在青藏高原的藏族,因受地理环境、经济、文化、宗教等因素的影响,其婚姻制度和风俗习惯独具特色。这些独具特色的婚姻习俗有些与现代婚姻法相冲突。我国实践证明,解决少数民族习惯与现代法之间冲突的最好途径是制定变通条例。为了避免与婚姻法发生冲突,西藏自治区人大及其常委会结合当地的具体情况,于1981年制定了《西藏自治区施行<婚姻法>的变通条例》(以下简称变通条例),并于2004年进行了修正。变通条例的制定和实施对建立健全西藏自治区立法体系有着重要意义,同时,变通条例还存在着些许不足。

Tibetans live in Qinghai - Tibet Plateau, due to geographical, economic, cultural, religious and other factors, the institution of marriage and its unique customs and habits. These unique marriage customs in some way conflict with the modern marriage. Chinag practice has proved that the habits of ethnic minorities can solve the conflict between modern law and the best way is to develop modifications to the Ordinance. In order to avoid conflict with the Marriage Law, the Tibet Autonomous Region People＇s Congress and its Standing Committee of the specific local situation, in 1981 formulated the Accommodation Rules for the Implementation of the Marriage Law of the People＇s Republic of China. ＂（ hereinafter referred to the Accommodation Rules）, and amended in 2004. Modifications to the formulation and implementation of regulations on the establishment of a sound legislative system of the Tibet Autonomous Region is of great significance at the same time, modifications to the Ordinance still less than some.
