摘要 电子商务在给人们带来便捷时也带来很多新的纠纷,同时也给法律及传统纠纷解决模式带来新的挑战。通过分析B2C电子商务纠纷的特点以及原有的B2C电子商务纠纷解决模式:如调解、仲裁、诉讼存在的某些固有瑕疵,指出为使B2C电子商务健康有序的发展,势必形成一个由内部纠纷解决机制与外部纠纷解决机制组成的新的纠纷解决体系。 The rapid development of e-commerce brings convenience as well as many new kinds of disputes, thus posing a challenge both to the legal system and to traditional dispute resolutions. Based on an analysis of the characteristics of B2C e-commerce disputes and the intrinsic defects of traditional dispute resolutions such as mediation, arbitration and litigation, the author proposes that in order to create a healthy and orderly environment for the development of B2C e-commerce, a new system, which consists of both an inner system of dispute resolution and an outer system of dispute resolution needs to be formulated for dispute resolutions.
