On Legislation Reconstruction of Crime of Abducting and Selling People

打击拐卖人口类的犯罪一直是我国刑事立法和刑事司法的重要任务之一,而现行刑法将妇女、儿童以外的其他人口排除在外,造成了司法实践中关于拐卖人口类犯罪适用的困境,因此应对拐卖人口类的犯罪进行立法重构,以便更有效地预防和惩治拐卖人口的犯罪活动。

Cracking down crime of abducting and selling people has been an important task of our crimi- nal legislation and justice, however, the existing criminal law excluded the other people except women and children, resulting in the application dilemma of crime of abducting and selling people in judicial practice. Therefore, we should make legislation reconstruction of crime of abducting and selling peo- ple in order to prevent and punish criminal activities of abducting and selling people more effectively.
