The Judicatory Relief of the Rights of Chinese College Students

大学生权利司法救济的原则包括有限实体审查原则、程序性审查原则和用尽内部救济原则;法院对招生案件、评价案件和处分案件应适用不同的具体审查标准;应从扩大行政诉讼受案范围和加大司法解释力度等方面进一步完善我国大学生权利司法救济制度。

The principles of the judicatory relief of the rights of Chinese college students include the principle of censorship of individuals, the principle of censorship in accordance with legal procedures and the relief principle of using up internal resources. Different relief principles should be applied in cases of enrolling new students, appraisal and punishment to adjust to different standards of censor- ship. And further improve the relief system of the rights of Chinese college students in aspects of enlarging the scale of administrative proceedings and making greater efforts to explaining Chinese law system.
