论传统知识的法律保护模式构建——兼论2008年《专利法》新增关于遗传资源的规定

On traditional knowledge’s legal protection mode construction——On 2008 patent law’s added regulation on genetic resources

我国的传统知识在内涵和形态上有着不可比拟的丰富性,但随着经济全球化趋势和现代化进程的加快,传统知识及其生存环境受到严重威胁。由于过度开发和不合理利用及人们生活环境和条件的变迁,许多重要传统知识正面临消亡或失传。因此,探讨传统知识法律保护模式的构建问题,对保护我国的传统知识具有十分重要的意义。

The traditional knowledge of our country is abundant in the meaning and form. But with the globalization of economy and the rapid-speed of modernization, the traditional knowledge and its existing circumstances have been threatened badly because of the over exploitation and unconscionable use and the change of people’s living conditions. Lots of traditional knowledge is facing to die out. So discussing the construction of legal protection mode to the traditional knowledge has important meaning for the protection to our country’s traditional knowledge.
