从位格伦理的视角分析,人类基因表彰了一个潜在的具有完全道德意义和法律权利的具体位格,因此成为位格人的自然基础并具有尊严价值。在主体客体化的背景下,在现有法学理论和法律技术框架下,可以把人类基因法律地位归于特殊人格财产。但不能忘记人类基因的首要属性是人格,其次才是其物化后适用不可让渡规则的财产属性。

The human gene, from the prospective of Person Ethical Theory, manifests a specific Person with potential full moral significance and legal rights, and then it has become the natural basis of the Person with dignity values. Under the backgrounds of the objectification of the subject and in the framework of existing legal theory and legal technology, the legal status of human gene can be viewed as a special personality property. But we can not forget the most important attributes of the human gene is personality, followed by its properties of inalienable property.
