摘要
"严重损害就诊人身体健康"作为医疗事故罪的客观要件之一,对认定医疗事故罪与非罪产生了重要影响。但是,当前的立法和司法解释对"严重损害就诊人身体健康"都没有作出具体的解释和规定,使当前司法实践中关于认定存在诸多问题,造成卫生监督案件的移送和司法实践具体操作的紊乱。认定"严重损害就诊人身体健康"的具体标准,应该在遵循刑法依据的基础上适当考虑医学依据。
As the necessary factor of the medical malpractice crime,＂ injure the patient＇s physical health seriously ＂,is one of factors to judge malpractice being crime or not.There is neither certain definition nor accurately judicial interpretation,which would result in many problems in these practices,and difficulties of transferring of health supervision case and judicial practice.To confirm believed＂injure the patient＇ s physical health seriously ＂,should to follow the bases of criminal law and with due regard to medical evidence.
