Contextual Analysis of ‘Law’ and Its Discontents——With Particular Reference to Hart and The Concept of Law

哈特的《法律的概念》可谓是现代西方法理学的一颗明珠,它所倡导的语境分析方法引领了20世纪下半叶法理学的整个发展方向。该文正是对这一方法的集中研究,它揭示出了哈特将该方法应用于法哲学领域的发展过程,并在此基础上重点探究了J.L.奥斯汀的"言语行为理论"与哈特的分析法学之间的密切相关性,此种努力旨在批判性地考察语境分析方法的理论力量及其限度,丰富对哈特法哲学本身的理解,为当代中国的法学提供新的启示。

It may be said that Hart＇s The Concept of Law, which leads the new trend of the jurisprudence in the later twentieth century because of the contextual analysis in it, is an one bright pearl in contemporary western jurisprudence. This paper aims at revealing the developing process of this very research method in the Hart＇s works and particularly exploring the close relationship between the ＇speech acts＇ of J.L. Austin and analytical jurisprudence of Hart, and then intends to facilitate the understanding of Hart＇s legal philosophy and give insprition to contemporary China＇s law science through making a critical investigation of the theory power and its discontents of the context analysis of ＇Law＇.
