针对金融衍生品交易的法律监管进行了探讨。首先论述金融衍生品监管的必要性,然后从五个方面分析了金融衍生品交易监管存在的法律问题,在此基础上结合我国实际,论述了我国金融衍生品交易监管存在的缺陷,最后提出了完善全球和我国金融衍生品交易法律监管体系的思路,以期金融衍生品交易市场健康稳定的发展。

Discussions focus on the law supervision of financial derivative trading, Based on me explanation of the necessity of supervising financial derivatives, some legal problems in the supervision of financial derivative trading are analyzed from five aspects. Then an exposition concentrates on the defects in the supervision of financial derivative trading according to the practical situation in our country. At last, it is presented to perfect the law supervision system of financial derivative trading in our country and all over world so that the market of financial derivative trading can have the healthy and stable development.
