摘要
在城市土地公有制背景下,土地出让实现了土地归属与利用的分离。《物权法》确立了建设用地的分层出让,明确了土地出让合同的性质,承认了住宅用地期满后的自动续期。这有利于法律规则的统一,凸现私法理念,深入推进了土地市场化。
Against the background of public ownership of land,the assignment of land motivated the separation of possession and use.Property Law stipulates the multple level of lang assignment,definites the character of the contract of the assignment of land and sets up the rule of automatic update when the terms of the right to use construction land for dwelling houses expire.It contributes to the unity of law rules,highlighting the philosophy of civil law and advancing the effective use of land resource.
