摘要
日益严重的环境侵害问题引发了人们的高度重视。面对环境侵害,受害者通过各种渠道进行控告和申诉,以期获得救济。但囿于我国现有的相关法律制度在框架设计上存在缺陷,受害者往往无法得到合情合理的救济,由此引发新的社会矛盾和问题。笔者分析了环境侵害的涵义及特征,揭示了我国现阶段的环境侵害状况,并对相应的救济制度深入剖析,提出了完善救济制度的若干构想。
The increasingly serious issue of environmental infringement has attracted great attentions.The infringed complained and appealed through various ways in the hope of relief.The infringed used to gain no reasonable relief due to some designing defects of China's relevant legal systems,which has caused some new social problems.This article analyzes the definition and characteristics of environmental infringement,demonstrates China's present conditions of environmental infringement,deeply dissects some relevant relief systems and offers some ideas of perfecting the relief system.
