证据法学在英美的发端是在17世纪末，到18世纪初才有了吉尔伯特的证据法学问世，后来经过边沁、斯蒂芬、塞耶、威格莫尔等学者发扬光大，到20世纪初达到鼎盛。英美证据法至今已走过二百多年的历史，而中国则是百年之内的事情。今天我们将继续跟着法学家们的思维，进一步揭开美国政治与法律的面纱，一起探讨美国证据法的价值论基础。
The origin of evidence law in UK and US was in the late 17th century and the birth of Gilbert's evidence law was in the early 18th century.With the development of such scholars as Bentham,Stephen,Thayer and Wigmore evidence law reached its peak in the early 20th Century.So far Anglo-American evidence law has had a history of more than 200 years,while Chinese evidence law has had a history of less than 100 years.Following the thinking of jurists the veil of American politics and law will be further disclosed and the value basis of American evidence law will be discussed.
