摘要
我国未成年被告人权益保障的改进应当建立科学的法律制度体系、健全审判机构,提高审判人员素质、建立保释制度,实行隔离羁押,并从严格法定代理人参与制度、保障指定辩护有效性、完善社会调查制度、适用特殊的审判方式与程序、建立彻底的公开审判制度、建立暂缓判决制度等方面完善审判制度。为发现并督促实践中违法现象的纠正、推动法律制度的完善、促进未成年人案件办案人员的成长、推动未成年被告人权益保障事业的发展,还应当建立适当的评价机制。
In order to improve protection of rights of juvenile defendants in our country,we should establish scientific legal systems,improve judicial instruments,enhance the quality of personnel of trial,set up the bail system,carry out segregation in custody,and improve the trial system from the aspects of making participation of legal representatives more seriously,safeguarding effectiveness of assignment of defense,improving the social survey system,applying the special trial way and procedure,establishing the complete open trial system and the suspended sentence system,and so on.In order to find and urge correction of illegal phenomena in practice,to push improvement of legal systems,to advance growth of staff of juvenile cases,to push forward development of protection of rights of juvenile defendants,we should set up the appropriate evaluation mechanisms.
