土地资源的刑法保护研究——兼论非法占用农用地罪

Study on Protection of Criminal Law for Land Resources——From the Angle of Crimes of Unlawfully Occupies Farmland

土地是社会生产中最重要的物质资料,它所提供的给养决定了人类生命体的存在与延续,因而保护土地就是保护我们自己。但庞大人口对有限土地的需求近似于无限,在供需矛盾严重不平衡的刺激下,对土地的破坏日趋严重,其破坏领域主要表现于对农用地的非法占有。面对这一违法情状,必须运用法律机制来防控和规制,实践中证明民事和行政手段略显单薄,需要启动刑法惩治这种严重危害土地资源的行为,作为刑法惩治破坏土地资源个罪之一的非法占用农用地罪,它的作用发挥将有效表现刑法对土地的独特呵护。

Land is the most important means of production in social productivity, which supplies provisions to existence and development of human beings. Thus protecting land means protecting ourselves. But huge population＇ s require of limited land is close to limitlessness. Land destroying is getting more and more serious under the stimulus of unequal imbalance between supply and demand. Destroyed areas are mainly unlawfully occupies farmland. We must start ways of law for prevention and control and regulation this act, but civil and administrative means are proved to have weakness in practice. We need start criminal law to punish the dangerous act. As one of the crimes to punish land resource, unlawfully occupies farmland, which play effectiveness will show unique care of criminal law for land.
