摘要
对检察机关在民事诉讼中的作用进行重新定位,完善保证该作用充分发挥的制度,是一个现实法律问题。检察机关职能扩大,从刑事领域扩展到民事和行政领域是检察机关职能发展的一般趋势。我国检察机关职能也应顺应变化,进行相应完善,允许检察机关提起公益民事诉讼。
Procuratorial organs＇ function in civil procedure needs to be improved to assure its role of being fully played, which is a law issue. It is a trend that its function extends from criminal field to civil and administrative field. In China, procuratorial organs are able to adjust themselves to the current transformation and they are permitted to institute civil proceedings.
