On the Basic Ideas of Intellectual Property Law

知识产权法的理念是指导知识产权制度设计与知识产权法运行的理论基础和根本价值,体现在知识产权法制度设计、执法机制的建立和运行、司法实践之中,并直接作用于当事人与知识产权执法、司法人员,形成"行动中的法"的思想观念。知识产权法的传统理念包括个体理念、个体智慧理念和创新理念。为保护非物质文化遗产这种新客体,知识产权法衍生出新的法律理念:社区主体理念、社区智慧理念和传承理念。

The idea of the intellectual property law is the theoretical basis and the fundamental value for the design of the intellectual property system and the implementing of the intellectual property law. It is embodied in the design of the intellectual property law system, the establishing and implementing of enforcement mechanism, and the judicial practice. It is also the thought and concept that will have a direct impact on the person concerned, the law enforcement officials and judicial officers. The traditional idea of the intellectual property law includes individual idea, individual intelligent idea and the idea of innovation. To protect the Non-material Cultural Heritage, there will be some new concept of law derived form the intellectual property law, namely the community mainbody concept, community intelligent concept and the inherited concept.
