近代以来中国商会的自治活动,为民间社会由集权走向分权,由善政走向善治,提供了制度变迁契机。在这个目前尚在行进的制度变迁中,虽然受到路径依赖和制度惯性的约束,但是具有转型特色的自治秩序正在形成。近代以来中国商会在会员规则、会董规则、监督规则等自治表达上的变迁,以及在选举规则、议事规则、公断规则等自治实践上的变迁,虽然有过断裂,但一经承续,就又开始形成一定的以秩序为依归的制度均衡,为转型中国社会治理提供了可资利用的制度资源。
