A Reflection and Re-construction on External Law Circumstance of Chinese Modern University System

现代大学制度构建的核心是探寻保障大学自治与接受干预之间的平衡点;法的自生系统论与"反身法"理论为寻找这一平衡点提供了重要的思维路径转向;在构建我国现代大学制度所需的外部法律环境过程中,我们应该循着"程序与间接"的思维方式展开研究,以期我国现代大学制度建设的突破与进展。

The fundamental question of constructing Chinese modern university system is to seek a balance point between guaranteeing internal autonomy and accepting external manage of the university. It is the theory of autonomy of law and reflexive law that produces a new idea to deal with the perplex problem. In order to gain substantive development in the work of constructing Chinese modern university system, we should take the ＂procedure and indirect＂ thinking way seriously into account in our study.
