摘要
劳务派遣涉及三方主体,雇佣与使用相分离的典型特征给其劳动关系的认识带来困难,科学准确地界定劳务派遣关系中的劳动关系,对于劳务派遣法律规制具有重要的理论及实践意义。根据传统劳动关系从属性的界定标准,在劳务派遣关系中,派遣单位与要派单位组合成雇主与派遣劳动者形成一重劳动关系,这一重劳动关系在派遣单位与要派单位两个层次之间分别运行。
Given that placement involves the three subjects,its distinct feature of separation of employing and working poses a challenge for understanding of its Employment Relationship.A scientific and accurate recognition of the employment relationship is of great significance for legal regulation of the placement theoretically and practically.According to the subordination's standard of traditional employment relationship,in the placement,the Staffing Firm and the Accepting Unit composite the employer to establish single employment relatinship with the placed employee,and the single employment relationship works respectively betweem the Staffing Firm and Accepting Unit.
