摘要
片面共犯是客观存在的社会现象,无论对片面共犯的承认还是否认,都在试图解决片面共犯的定罪根据问题,片面共犯属于共同犯罪,其在理论、立法、司法皆有体现,但片面共犯的立法还需要进一步完善。
Unilateral complicity is an objective social phenomenon.Whether you accept the unilateral complicity or not,it is trying to resolve the foundation of conviction of unilateral complicity.Unilateral complicity belongs to co-transgress,it is incarnated in theory,legislation and justice field;but legislation of unilateral complicity needs to be more consummated.
