Public Participation and Transition of Theory of Persons of Administration

公众参与是当今世界公共行政领域的基本潮流之一,它对行政主体理论产生重大影响:行政主体制度的功能从传统的单一分权功能拓展到多元功能,行政主体的类型也由公法人一元主体转向私法人与公法人并存的多元主体,行政主体与相对人的关系也面临重构。我国处于复合转型期,行政主体理论与制度既要发挥传统分权保障功能,又要适应公众参与潮流在行政主体制度功能多样化、类型多元化、行政主体与相对人关系平等化等方面的新要求。

Public participation is one of the trends of public administration all over the world, which has great influence on theory of persons of administration. The function and types of persons of administration system are going from unitary to muhinomial; meanwhile the relation between persons of administration and counterparts should be reconstructed. In the complicated transforming period of China, the theory and system of persons of administration should not only have decentralization function, but also meet the needs required by public participation.
