摘要
劳动争议纠纷已成为当前社会矛盾重要组成部分。但劳动纠纷绝非是简单的法律问题,在劳动纠纷现象的背后,是希望通过解决劳动纠纷的法律手段去实现超过劳动纠纷所能涉及的范围的其他诉求。当然,这样的劳动纠纷也绝非是法院和劳动仲裁委员会依据法律进行仲裁和判决所能解决的。把握劳动争议实际为涉及就业和社会保障的民生问题、政府体制、部门协调、严格执法、社会心理等方面的社会问题找到彻底解决当前劳动争议纠纷的路径。
Labor Dispute has become the main part of the social contradictions, but it is not a simple legal problem. Behind the phenomenon of labor dispute, a desire is expressed, which is to resolve the others appeals beyond the labor dispute through resolving the labor dispute. Of course, those disputes can not be resolved easily by the court and labor arbitration committee by legal means. The way to resolve this dispute can be found by combining the different problems such as the well-being of people, government system, department coordination, serious law enforcement, social psychology and so on.
