摘要
根据现行刑法第313条规定,只有负有履行法院裁判义务的自然人拒不执行裁判才构成犯罪,单位拒不执行裁判不构成犯罪;但根据拒不执行裁判案的现状及其刑事法理论与实践,单位拒不执行裁判构成犯罪不仅必要、而且可行。
According to the 313th of the criminal law in China, it is a crime not to unit but natural subject who should carry out decision or order made by a people＇s court, but not. According to the present situation and the criminal theory and practice, it is necessary and feasible that it is a crime to unit refusing to carry out a decision or order made by a people＇s court.
