建立和完善巨灾保险法律制度,是有效应对我国巨灾风险的需要;是组织全社会力量抗灾、救灾的需要;是构建社会主义和谐社会的需要;是克服传统保险法局限性、更好地发挥保险业功能的需要。随着经济和社会的发展,探索和制定适合我国国情的巨灾保险法律制度,为现实所必要且必需。

This paper points out that it is necessary to build and advance the huge disaster insurance legal system for the demand of relieving disaster＇ s losses efficiently, for the need of combating and rescuing the disaster by organizing all the communities, for the need of building a harmonious socialist society, and for the demand of avoiding the localization of traditional insurance and better exer- ting the function of insurance. With the social and economic development, it is essential to explore and constitute an insurance legal system for huge disaster, adapted to China＇s actual situation.
