我国土地征收制度中的权力资本化问题研究

Study on the Issue of the Capitalization of Power in the Land Expropriation System of China

现行对征收制度弊端的研究多集中于"公共利益问题"的探讨,而忽视了这一规则生成的背景分析。如果从政治和经济交互作用的关系视角,通过对公共权力"所有权"与"行使权"的分离,可以看出征收制度背后的权力资本化是产生这一问题的原因。

The studies for the drawbacks of the existing expropriation system are often focused on “public interest” without considering the analysis on generation background of the rules. From the perspective of interaction of politics and economy, through the separation of “ownership” and “executing right”, we can see that the capitalization of power behind the expropriation system is the cause of this problem.
