On the Concept Innovation of Government Ruled by Law in China

法治政府的建设应具有适当的理念根基。梳理和借鉴西方法治政府建设的理念演进,提出符合中国法治政府建设实际的四大理念创新:人权主义是我国法治政府建设的价值理性,法治主义是我国建设法治政府的工具理性,宪政主义是我国法治政府建设的制度理性,服务主义是我国法治政府建设的行为理性。

The construction of government by law should have an appropriate idea foundation. Carding and drawing lessons from the western concepts of rule by law in the evolution of government construction, the paper puts forward four concept innovations in llne with the actual construction of the Chinese government by law： human rights is the value rationality; rule by law is the instrumental rationality; constitutional doctrine is system rationality; and service is the behavior rationality.
