Sixty Years of Construction of the Legal System in New China:Experience Summary and Prospects Ahead

中华人民共和国的法律制度体系,是在彻底废除国民党政权以《六法全书》为基础的旧法统前提下,以马列主义的国家观和法律观为指导,结合中国国情与实际,借鉴苏联社会主义法制模式建立起来的。新中国成立60年来,随着时代的演进并经过不断的探索和艰苦的努力,已经逐步建立和形成了中国特色的社会主义法律制度,法制建设取得了显著成绩,并积累了较为丰富的实践经验。但另一方面,中国的法制建设也给我们留下了较为沉痛的教训。因此,回顾60年来法制建设的发展历程,吸取历史的教训,正确总结法制建设值得肯定的经验,可以为当前全面落实依法治国方略,建设社会主义法治国家提供有益的借鉴。

It was only after the abolishment of the old legal system based on The Complete Book of Six Laws carried out by the National Party that the legal system of the People＇ s Republic of China was established. This new legal system was set up under the guidance of Marxist views on state and law, in the light of the national situation and reality, and by drawing on the model of the legal system of Soviet Socialism. Over the past 60 years since New China was born, we have built up our socialist legal system with Chinese characteristics, obtained noticeable achievements in its construction, and accumulated rich experience along with the passage of time and through constant explorations and strenuous efforts. On the other hand, the construction of the legal system in New China has left us lessons from bitter experiences. Therefore, by reviewing the process of construction of our legal system over the past 60 years, by drawing lessons from historical experiences, and by correctly summarizing the positive experience drawn from the construction of our legal system, we are able to provide beneficial guidance and significant reference for the current implementation of the general plan aimed at riding the state by law and for the building of our country into a socialist state under the nile of law
