再生证据是经犯罪嫌疑人、被告人及其利害关系人在案发后,为了逃避法律制裁,在进行各种反侦查活动中形成的,能够证明犯罪情况的一切事实。由于其生成方式和切入角度的特殊性,在反贪查案中有着不可忽视的价值和作用,往往会使案件出现"柳暗花明又一村"的转机。本文结合办案实例,对再生证据的特征、种类、运用以及收集原则等作一阐述,以期有助于反贪查案工作。

The regenerated evidences are all the facts that can prove the crime, formed during the various antiinvestigative activities by the criminal suspects, defendants and their stakeholders after the case, in order to avoid legal sanctions. Because of the special nature of its generation means and cut-in angle, the value and role can not be ignored in the anti-corruption investigation, which often make the case a ＂vista＂ turn for the better. This paper, combined with the real cases, exponded the characteristics, types, use and the collection principles of the regenerated evidence to make facilitate to the work of anti-corruption investigation.
