The development of interaction of environmental governance and public participation under the view of soft law

环境问题的复杂性与环境主体的多元利益诉求,决定了在环境治理中,需要运用软硬兼施的混合法模式,选择两条腿走路,软法与硬法并行不悖。环境治理是一个上下互动的管理过程,它强调动态的参与和交流。在软法的视野下,由开放的环境管理与广泛的公众参与整合而成的环境治理模式日益成为环境法治的主导性模式。

The complexity of environmental problems and the muhiple interests demand of environment subject require us to use model of uniting soft law and hard law in environmental governance, that is, the soft law and hard law are used at the same time. Enviromnen- tal governance is an interactive management process, which emphasizes dynamic participation and communication. In the view of soft law, the environmental governance pattern integrated with the open environment management and wide public participation increasingly becomes the leading model in environmental legal system.
